CHAPTER VI. - THE RESPECTIVE RIGHTS AND DUTIES OF THE SPOUSES

Article 212. Les époux se doivent mutuellement fidélité, secours, assistance.

The spouses owe mutual fidelity, relief, assistance.

Article 213. Le mari doit protection à sa femme, la femme obéissance à son mari.

The husband owes protection to his wife, the wife obediance to her husband.

Article 214. La femme est obligée d'habiter avec le mari, et de le suivre partout oú il juge à propos de résider : le mari est obligé de la recevoir, et de lui fournir tout ce qui est nécessaire pour les besoins de la vie, selon ses facultés et son état.

The wife has to inhabit with the husband, and follow him everywhere he judges appropriate to reside: the husband has to receive her, and supply her with everything necessary for the needs of living, according to his abilities and state.

Article 215. La femme ne peut ester en jugement sans l'autorisation de son mari, quand même elle serait marchande publique, ou non commune, ou séparée de biens.

The wife may not stand in court without the authorization of her husband, even if she were a public merchant or not in common, or separated in goods.

Article 216. L'autorisation du mari n'est pas nécessaire lorsque la femme est poursuivie en matière criminelle ou de police.

The authorization of the husband is not needed when the wife is prosecuted in criminal or police matters.

Article 217. La femme, même non commune ou séparée de biens, ne peut donner, aliéner, hypothéquer, acquérir, à titre gratuit ou onéreux, sans le concours du mari dans l'acte, ou son consentement par écrit.

The wife, even not in common or separated in goods, may not give, alienate, mortgage, acquire, either free of charge or subject to payment, without the assitance of the husband in the deed or his written consent.

Article 218. Si le mari refuse d'autoriser sa femme à ester en jugement, le juge peut donner l'autorisation.

If the husband refuses to authorize his wife to stand in court, the judge may give the authorization.

Article 219. Si le mari refuse d'autoriser sa femme à passer un acte, la femme peut faire citer son mari directement devant le tribunal de première instance de l'arrondissement du domicile commun, qui peut donner ou refuser son autorisation, après que le mari aura été entendu ou dûment appelé en la chambre du conseil.

If the husband refuses to authorize his wife to contract a deed, the wife may have summon her husband directly before the court of first instance (County Court) of the district of the common domicile, which may give or refuse his authorization, after the hearing of the husband or his summon before the chamber of the counsel.

Article 220. La femme, si elle est marchande publique, peut, sans l'autorisation de son mari, s'obliger pour ce qui concerne son négoce; et, audit cas, elle oblige aussi son mari, s'il y a communauté entre eux.
Elle n'est pas réputée marchande publique, si elle ne fait que détailler les marchandises du commerce de son mari; mais seulement quand elle fait un commerce séparé.

The wife, if she is a public merchant, may, without the authorization of her husband, to bind herself concerning her trade; and in case, she binds also her husband, when there is community between them.
She is not considered as public merchant, if she only retails the merchandise of the trade of her husband; but only when she is trading separately.

Article 221. Lorsque le mari est frappé d'une condamnation emportant peine afflictive ou infamente, encore qu'elle n'ait été prononcée par contumace, la femme, même majeure, ne peut, pendant la durée de la peine, ester en jugement, ni contracter, qu'après s'être fait autoriser par le juge, qui peut, en ce cas, donner l'autorisation, sans que le mari ait été entendu ou appelé.

When the husband is struck by a conviction involving affliction or dishonour, even pronounced by contumacy, the wife, even when she is of age, may only, during the duration of the penalty, stand in court or contract deed, after being authorized by the judge, which may in this case, give authorization, without the hearing or summon of the husband.

Article 222. Si le mari est interdit ou absent, le juge peut, en connaissance de cause, autoriser la femme, soit pour ester en jugement, soit pour contracter.

If the husband is prodigal or absent, the judge may, with full knowledge of the facts, authorize the wife to stand in court or contract deed.

Article 223. Toute autorisation générale, même stipulée par contrat de mariage, n'est valable que quant à l'administration des biens de la femme.

Each general authorization, even stipulated in a mariage contract, is only valid for the administration of the wife's goods.

Article 224. Si le mari est mineur, l'autorisation du juge est nécessaire à la femme, soit pour ester, soit pour contracter.

If the husband is under age, the authorization of the judge is neccessary to the wife, to stand in court or contract deed.

Article 225. La nullité fondée sur le défaut d'autorisation ne peut être opposée que par la femme, par le mari, ou par leurs héritiers.

The nullity founded on the absence of authorization can only be opposed by the wife, the husband, or their heirs.

Article 226. La femme peut tester sans l'autorisation de son mari.

The wife may make her will (testament) without the authorization of her husband.
