John and Ann also left a will, executed at the death Ann, as the last survivor. From this three points are clear:

a. John had been married previously, and had children. See below.

b. John had been able to purchase a schooner "Ann Livingston" because of the money and goods brought to the marriage by Ann. Roslyn Livingston-Schubert: “In the ship's list, Dundee, in 1853 a ship called the "Anne Livingston" was registered. It had as master and owner John Livingston. The ship weighed 113 tons, was built in 1850 and was probably (going on its smallish size) a coastal trader.”

c. The will mentions that late in life John and Ann had debarred John's son William from inheriting.

Roslyn Livingston-Schubert has passed on extra information:

"Erected by Anne Lindsay in memory of her husband John Livingstone, shipmaster, Errol who departed this life 15 Oct 1859 aged 64 years (DOB 1795). Also their son, Andrew who was drowned at sea 5th April 1859 aged 27 years (DOB 1832). William A Livingstone, shipowner eldest son of the above John Livingstone who died at Loan Cottage, Errol 12th May 1906, aged 83 years (DOB 1823): also his wife Margaret Oliver Coupar who died at Loan cottage, Errol 10th Jan, 1908, aged 75 years. Both being interred in western cemetery, Dundee". The grave is decorated with a carved sailing ship.
Concerning that previous marriage, Roslyn Livingston-Schubert has informed me of the following, correcting an error I made initially, placing the following family in another family tree:-

This baptism, or in fact record of a baptism elsewhere, mentions that the birth actually happened in BERWICK, just over the Scottish border in England, and that JOHN was a Seaman.

The following is again from Roslyn:

Alexander, the last-born child and 5th son, emigrated to Australia on board the BRISEIS, which arrived in 1855. He was 17-18 years old, paid his own passage and described himself as a mechanic.

Alexander Married 19th June 1866 in Sandhurst (Bendigo). 28 (really 26) and living in Sale, to Catherine Elizabeth Phillips, 22, Irish, who lived in Sandhurst. He stated his parents were John Livingston, mariner, and Elizabeth A. Elshindar.
